Looks like def no $$ as epidemics were part of the contract . . .

I would disagree with their assessment. I doubt a court would allow them to surgically remove these games from their schedule and still play others. It appears Illinois is waiving credible fear of risk by playing other games and hosting practices in the manner they are. It’s like me saying I can’t possibly eat another bite to avoid the broccoli but then turning around and shoveling cake in my face.
Although I believe we would prevail in court, I doubt our administration would pursue it. After handling previous contracts with NW (b-ball) and Barb Smith (WBB coach);, I can’t trust their contract decisions.

Cost of litigating this, plus the time to get it done, would probably eat up the payout anyway.

Couldn’t you argue they would also spend more money than this game is worth? It’s not like Illinois schedules us in a lot of sports where we have to worry about ruffling feathers. My guess is we could work out a settlement. Also, ISU does employ attorneys on staff.

And most of ISU's attorneys are there for things other than instigating litigation. The Illini have nothing to lose should we decide to make this a fight. Why would they settle?

That is what so many lawyers absolutely depend on...the cost of litigation being so much more expensive than settling. That (money) is the very core and basis of the legal system. Sad to see the game go. Maybe they could fight it and maybe not. For certain it would cost them more than the payday to fight it.

Portland State was scheduled to play 2 FBS's that backed out. They are wondering why these games fall under "Act of God" but the the conference games don't.

Good question. And Wisconsin has said they'll "wait and see" about a bowl game. So you know, you cancel 2 or 3 home games due to the virus, but travel to maybe Florida or California or Texas to play a bowl game? And Illinois, they cancel against us but travel to Rutgers??

Thought about this some ... I think canceling nonconf games over conf games makes a lot of sense. That said, some kind of settlement would seem appropriate, since they canceled the game by choice, no matter how understandable/wise I may think it is .. they canceled a game they could have played .. they should offer a settlement. Maybe the "act of god" thing was the first "offer" ... zero $ ... just to set stage for something less without admission this game is playable.

I don't have any knowledge of how the FBS/FCS payouts work. The FCS team always has to travel to the big house of the FCS opponent, or at least it looks that way. Does the payout to the FCS team have a relation to attendance at the stadium? If so, then I could see why the FBS opponents may balk at the payout. If the payout is based on the gate at the stadium then with the COVID restrictions and empty or close to empty stands the money would come directly out of the FBS bank instead of gate receipts. Does anyone know how this works?

I just don't know anything about any of that. But using common sense .. how can they cite "act of god" contractually, when they are scheduled to play games later in season ? They are simply choosing (albeit, wisely) to put a lower priority on certain games (nonconference). I fail to see how that is our problem .. right now, both teams are fully able to play. That said, I think a very low settlement is fair given situation .. like 100-150k or something. We don't want to be ... nor do we want to be seen as ... trying to take advantage of situation. But we have budgets and so do they ... figure out a fair number and get a another long overdue game rescheduled.

I don't disagree with you fourth but when you are talking contractural matters ... common sense is not an issue on the table.

Yep .. I didn't mean to imply common sense should prevail. Just admitting i'm not at all familiar with these types of contracts ... so all I got to offer is my version of common sense. So how can Illinois cite "act of God" for our game the first week of season, assuming both teams are currently able to play, and they are not canceling later games. Now maybe they would argue, they won't be ready by week 1 given summer escalation of Covid.

Anyway, ISU lawyers shouldn't burn any bridges over this, but a token settllement would be fair. We want to play the game, they are able to play the game ... they canceled, not us. Half seems a bit much for situation. Given respective budgets and impacts to each program's P&L, just throw us 100-150k and call it a day.

About 3 Saturdays ago LL was on a CU morning sports radio show talking about the cancellation. He and the Illini AD will talk again after the dusts clears concerning the actual FB season that may happen.

This makes sense to me. There is so much uncertainty right now it is probably the best course of action to discuss this after everyone knows what the 2020 season will look like. With time now rapidly running out, we should be getting some clarity pretty soon.
Correct me if I am wrong, but it was the Big10 that decided for their members to play a strictly Big 10 schedule. If that is accurate then the Illini did not have a choice but to cancel the non-conference game with us. ISU may be ready to play and the Illini may be ready to play but they have to adhere to their conference guidelines. Our beef for the lost revenue would be with the Big 10 not so much the Illini themselves. It would be a decent gesture to provide some compensation to the FCS teams for the lost revenue. But college football at the Big 10 level is not truly a sport any longer it is big, big business. These decisions will be business decisions strictly I would assume. Rather than a percentage of the lost payday, I would like to see the Illini discuss some future dates to play as a way to make up the lost opportunity. That would not do the Redbirds any good this year but having the Illini to agree to a couple of games on future schedules would be nice.

On paper, in "normal times", seeking some compensation makes all the sense in the world. But given the likelihood that UIUC, and all football teams everywhere, are going to take it in the shorts revenue-wise this year, probably not going to see any dough one way or the other. Much better shot at getting another shot sometime in the future.

Reminder- Safe to play @ Rutgers.
Not safe to host ISU.

There has been some reporting, ESPN source if that means anything, that the BIG 10 has advised members that they may not play football in 2020 at all. No final decision but I think it is looking more like the season will be canceled. Obviously the people who make decisions are not going to go to the last day ... they are going to hold off until the very last second to make a call. I guess with Billions of dollars on the line they have to. My own personal opinion is the priority is on the Billions of dollars not on the players and coaches.

This game will now be played in 2028. Hopefully we're actively recruiting 8th graders to be ready their senior year at ISU to kick some Illannoy butt!
